This policy explains how Wintax – Formação e Consultoria, Lda. processes the personal data of visitors and users of the website www.wintax.pt, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, “GDPR”), Law No. 58/2019 of 8 August, and Law No. 41/2004 of 18 August (on privacy in electronic communications and cookies), as currently in force.

This policy applies only to the website. The processing of personal data carried out in the course of providing services to our clients is governed by the respective contracts and specific information.

3. What data we collect

You do not need to provide personal data to browse this website. We process personal data in the following situations:

  • Contact form: your name, email address and the content of the message you send us, so that we can reply to your request.
  • Contact by email or phone: the data you provide in those communications (for example, name, contact details and information relating to your request).
  • Server technical logs: the server where the website is hosted may automatically record technical access data (such as the IP address, the date and time of access and the browser type), which are necessary for the operation and security of the website.

We ask that you do not send sensitive personal data or complete tax documents through the form. If this type of information needs to be shared, we will tell you the appropriate channel.

4. Purposes and legal basis

  • Replying to requests for information and contacts made through the website: based on pre-contractual steps taken at your request and on your consent, given when you submit the form (Article 6(1)(a) and (b) of the GDPR).
  • Operation and security of the website: based on Wintax’s legitimate interest in keeping the website secure and operational (Article 6(1)(f) of the GDPR).
  • Compliance with legal obligations to which Wintax is subject, where applicable (Article 6(1)(c) of the GDPR).

Data collected through the website are not used for direct marketing, nor for automated decision-making or profiling. Providing the data requested in the form is necessary for us to reply to your request; without them, we are unable to do so.

5. Recipients of the data

Your data are not sold or disclosed to third parties for their own purposes. They may be processed, on behalf of Wintax and under contracts that guarantee their protection, by the following service providers:

  • the website hosting provider;
  • the email and backup storage service provider used by Wintax (Google), which receives a copy of the messages sent through the form and stores backup copies of the website.

Data may also be disclosed to public authorities where required by law.

6. Transfers outside the European Union

The website is hosted on servers located in the European Union. Some of the providers mentioned above (in particular Google) may process data in countries outside the European Economic Area. In such cases, the transfer is based on a European Commission adequacy decision or on standard contractual clauses and other appropriate safeguards provided for in the GDPR.

7. Retention period

  • Contact request data: kept for as long as necessary to reply to the request and, if it does not lead to a relationship with Wintax, for a maximum of 24 months after the last contact, after which they are deleted.
  • If you become our client, the data will be processed under the contractual relationship and applicable legal obligations, for different periods.
  • Server technical logs: for the period strictly necessary for security and operation, as determined by the hosting provider.

8. Your rights

Under the GDPR, you may at any time:

  • access your personal data and obtain a copy;
  • request the rectification of inaccurate or incomplete data;
  • request the erasure of data where there is no ground for keeping it;
  • request the restriction of processing;
  • object to processing, in the cases provided for by law;
  • request the portability of the data you have provided to us;
  • withdraw your consent, without affecting the lawfulness of processing carried out until then.

You also have the right to lodge a complaint with the Portuguese supervisory authority, the National Data Protection Commission (CNPD), at www.cnpd.pt.

9. Security

Wintax adopts appropriate technical and organisational measures to protect personal data against loss, unauthorised access, alteration or disclosure, including encrypted connection (HTTPS), access control and backups. No system is completely infallible, so, in the event of a data breach that may affect you, we will act in accordance with the GDPR.

10. Links to other websites

This website may contain links to third-party websites. Wintax is not responsible for the privacy and cookie policies of those entities, so we recommend that you read them.

11. Cookies policy

Cookies are small text files stored on your device when you visit a website. They allow, for example, a website to work properly or usage statistics to be collected.

This website uses only strictly necessary cookies for its operation (for example, to maintain security and the browsing session). These cookies are exempt from consent under Law No. 41/2004.
